Terms and conditions of the newsletter

§1. Preliminary provisions

  1. The Regulations set out the rules for the Provider’s service of delivering the Newsletter (in the form of digital content) via email.
  2. Each User and Consumer is required to read and accept the terms and conditions set forth in the Terms and Conditions before entering into an Agreement with a Provider.

§2. Definitions

Definitions used in the Regulations should be understood as follows:

  1. Provider – BISS Drukarnia Opakowań Skowrońska Spółka komandytowa, ul.

  2. User – an individual with full legal capacity who subscribes to the Newsletter, and thus enters into an Agreement with the Provider.
  3. Consumer – an individual who enters into a contract with the Provider in the scope not directly related to his/her business or professional activity.
  4. Entrepreneur on the rights of the consumer – a natural person who enters into a contract with the Provider directly related to his business activity, when the content of this contract shows that it does not have a professional character for him, arising in particular from the subject of his business activity (as defined in CEIDG).
  5. Website – Internet service, maintained by the Provider, available at: https://biss.com.pl/
  6. Newsletter – digital content delivered to individuals who have subscribed via the subscription form posted on the Provider’s Website.
    An element of the Newsletter service may also be the so-called.
    lead magnet (a gift for signing up, e.g. an e-book), which is delivered to the User once after signing up for the Newsletter.
  7. Digital environment – computer hardware, software and network connections used by the User to access the digital content of the Newsletter and use the Website.
  8. Subscription Form – a form available on the Website that allows to conclude a contract for delivery of the Newsletter.
  9. Agreement – an agreement concluded at a distance with the User within an organized system of concluding agreements at a distance (including the Subscription Form on the Website), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of remote communication up to and including the conclusion of the agreement.
  10. Regulations – these rules and regulations.

§4. User's digital environment

  1. In order to use the Website and sign up for the Newsletter, you need:
    1. A terminal device with access to the Internet, an operating system and an Internet browser that allows you to browse the Internet,
    2. pdf, word, excel file viewer,
    3. active electronic mail (e-mail) address.
  2. The provider shall take technical and organizational measures to ensure the User’s secure access to the Website and use of the Newsletter, in particular measures to prevent access and modification of personal data by unauthorized persons.
  3. The user is prohibited from providing unlawful content.
  4. The Provider is entitled to a technical interruption in the operation of the Website, necessary for the planned ongoing operation and maintenance of the server and software. In the event of a planned interruption, Users will be clearly notified of this on the Website.
  5. The Provider, to the fullest extent permitted by law, shall not be liable for disruptions, including interruptions in the functioning of the Website caused by force majeure, unauthorized acts of third parties or incompatibility with the User’s Digital Environment.

§5. Newsletter subscription

  1. The newsletter is free of charge. There are also no delivery costs associated with its delivery. The conditions for providing this service are described by the Provider on the Website.
  2. In order to receive the Newsletter, you need to take the following steps:
    1. complete the Newsletter subscription form provided on the Provider’s Website;
    2. consent to the processing of data for the purpose of sending the Newsletter covering, among other things Direct marketing of the Provider’s products and services;
    3. read and accept these Terms and Conditions and sign up by clicking the “Sign Up” button.
  3. At the moment of expressing the will to receive the Newsletter by clicking “Subscribe” by the User, an agreement for the provision of Newsletter delivery service is concluded.
  4. In the case of subscribing to a Newsletter for the purpose of downloading an e-book, the first Newsletter with a link to download the e-book will be delivered immediately after the Newsletter User performs the actions specified in the preceding paragraph. Subsequent Newsletters will be delivered by the Provider at the frequency specified in the Newsletter description posted on the Website.
  5. In a situation where the User wants to download an e-book, but does not want to provide his/her email, then it is possible to purchase the e-book. If you are interested in purchasing the e-book, please contact the Provider via email – biuro@biss.com.pl
  6. The Newsletter Delivery Agreement is concluded for an indefinite period of time and may be terminated at any time with immediate effect. The Newsletter Delivery Agreement may be terminated by unsubscribing in accordance with the instructions contained in each Newsletter or by sending the appropriate request to the Provider at the email address or in writing to the address specified in §3 of the Terms and Conditions.

§6. Deadline for delivery of digital content (Newsletter)

  1. The Provider shall deliver the Newsletter to the Consumer immediately after the conclusion of the Contract. In case the Newsletter or other digital content (e.g., lead magnet) is to be delivered at a later date, the Provider shall clearly inform about it in the description of the digital content on the Website.
  2. Digital content (including the Newsletter) shall be deemed delivered when it has been made available to the Consumer in the form of a link to download or read the digital content. Digital content is considered delivered when the Consumer has accessed it.

§7. Complaint (Liability for non-conformity of performance with the contract).

  1. The provider is obliged to provide the Consumer and Entrepreneur on the rights of the consumer with the Newsletter service in accordance with the contract (the so-called consumer warranty).
  2. If the Consumer or Entrepreneur on the rights of the consumer finds non-conformity with the contract, he should inform the Provider, specifying at the same time his claim related to the found non-conformity (filing a complaint).
  3. The User shall submit a complaint in writing or by e-mail to the address specified in §3 of the Regulations.
  4. The time limit for the Provider to process a complaint is 14 days from the date of a properly submitted complaint.
  5. The user who is a Consumer has the opportunity to use out-of-court means of handling complaints and claims. Among other things, he has the opportunity to:
    1. to apply to a permanent amicable consumer court with a request to resolve a dispute arising from the contract,
    2. to apply to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for an amicable settlement of the dispute,
    3. use the assistance of a district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection.
  6. Consumers can also file a complaint through the EU’s online ODR platform, available at: http://ec.europa.eu/consumers/odr/.
  7. For more detailed information on out-of-court complaint and redress of grievances, the consumer can look at http://www.uokik.gov.pl.

§8. Right of withdrawal from the contract

  1. The user may withdraw from the Newsletter delivery contract at any time.
  2. For this purpose, the User should inform the Provider of his intention to withdraw from the contract by sending the appropriate statement in writing or electronically to the address given in §3 of the Regulations.
  3. Consumer and Entrepreneur on the rights of the consumer can use the model withdrawal form for this purpose. However, it is not mandatory. Model withdrawal form: Addressee (Beneficiary’s data):
    I hereby inform of my withdrawal from the contract for the provision of the Newsletter.

  4. In the event of withdrawal from the contract for delivery of the Newsletter, the User is obliged to stop using the Newsletter and the gift for subscription and sharing them with third parties.

§9. Copyright

  1. The digital content available on the Website, and in particular the materials included in the Newsletter and the gift for subscription (e.g., e-book), are works and are protected by copyright, and these rights are vested in the Provider or its associates, and who have granted the appropriate licenses to the Beneficiary.
  2. The User may use the Newsletter and other content available on the Website on the basis of permitted private use.
  3. A user interested in a wider use of the above. content should contact the Provider and undertake individual negotiations.
  4. Unauthorized distribution of the above. content may result in civil and criminal liability.

§10. Personal Data and Cookies

The rules for the processing of personal data and the use of cookies are described in the Privacy and Cookies Policy available at: www.biss.pl/polityka-prywatności

§11. Final provisions

  1. Contracts concluded by the Provider are concluded in Polish.
  2. The provider reserves the right to make changes to the Regulations for important reasons, i.e.: changes in legislation, changes in the scope of the service or technical conditions of its provision, to the extent that these changes affect the implementation of the provisions of these Regulations. The changes do not apply to contracts concluded before the introduction of changes to the Regulations.
  3. Matters not regulated by these Regulations shall be governed by generally applicable provisions of Polish law, in particular the Law on Consumer Rights.
  4. The regulations apply to contracts entered into as of October 1, 2024.
